1. Purpose
This Commercial Licensing Policy explains how KANAPURO grants permission to use commissioned work, Products, and other KANAPURO Content for commercial purposes.
This Policy forms part of the KANAPURO Terms of Service and should be read together with the Commission Policy and any applicable Commission Agreement.
2. Ownership
Unless expressly stated otherwise in writing, KANAPURO retains all Intellectual Property rights in artwork, designs, written works, software, and other original creative works.
Purchasing a Product or Commission does not transfer copyright or ownership.
Customers receive only the rights expressly granted by the applicable license.
3. Personal License
Unless another license is purchased, Products and Commissions are provided under a personal, non-commercial license.
A Personal License generally permits personal enjoyment, display, profile images, wallpapers, and other private, non-commercial uses.
A Personal License does not permit commercial exploitation or revenue-generating use.
4. Commercial License
A Commercial License may be purchased separately where offered.
Unless otherwise stated in writing, a Commercial License generally permits use of licensed work in connection with a business, brand, monetized content, advertising, merchandise, marketing, streaming assets, published media, or other commercial activities specifically described in the applicable agreement.
Commercial Licenses are limited to the rights expressly granted.
All rights not expressly granted remain reserved.
5. Exclusive Licenses
Exclusive Licenses are available only where expressly agreed in writing.
An Exclusive License does not automatically transfer copyright unless the agreement expressly states that ownership is being assigned.
The scope, duration, territory, and exclusivity of an Exclusive License will be defined in the applicable agreement.
6. Character Designs and Adoptables
Where KANAPURO transfers a Character Design, the recipient receives only the rights expressly granted by the applicable transfer terms.
Unless expressly stated otherwise, Character Design transfers do not include copyright ownership in the original artwork, source files, templates, written material, species, worldbuilding, or other associated KANAPURO Content.
Commercial use of a Character Design requires a Commercial License unless commercial rights are expressly included in the written transfer terms.
KANAPURO may require that ownership transfers, trades, gifts, or resales be documented through reasonable records.
6.1 Rights KANAPURO Can License
KANAPURO can only license rights that KANAPURO owns, controls, or is authorized to license.
This Policy does not grant rights in third-party intellectual property, source material, trademarks, fictional universes, or characters owned by other rights holders.
7. Attribution and Credit
KANAPURO may require attribution or credit as a condition of certain licenses.
Where credit is required, the required credit format will be stated in the applicable agreement or product listing.
Removing credit, obscuring authorship, or falsely claiming authorship is prohibited unless expressly authorized in writing.
8. Prohibited Uses
Unless expressly authorized in writing, you may not:
- claim authorship of KANAPURO Content;
- remove copyright notices;
- sublicense licensed work;
- redistribute Products by themselves;
- use licensed work outside the scope of the applicable license;
- train artificial intelligence systems using KANAPURO Content; or
- otherwise exploit KANAPURO Content beyond the rights granted.
9. Additional Licensing
Certain projects may require custom licensing terms.
Examples include:
- publishing;
- games;
- software;
- books;
- corporate branding;
- mass merchandise;
- long-term commercial partnerships; or
- other specialized uses.
Where required, KANAPURO will prepare a project-specific license agreement.
10. Revocation
KANAPURO may revoke a license where permitted by law or contract if the license was obtained through fraud, material breach of the Terms of Service, material breach of a license agreement, or other circumstances expressly permitting revocation.
Revocation does not affect rights that cannot legally be revoked.
